Terms of Service

Same-day delivery availableClean units, serviced on scheduleOne call handles it all

These are the terms of service for renting portable toilets and related equipment from Porta Potty Rental LLC. Plain language, no legalese where plain words will do. By booking a rental with us — by phone, which is how every booking happens — you agree to these terms. If something here does not make sense, call (855) 343-0136 and we will explain it before you book, not after.

Quotes and Booking

Every rental starts with a phone call to (855) 343-0136. On that call we spec your rental: unit types, unit count, delivery address, rental dates, and servicing cadence. We then give you a quote for the full rental — delivery, setup, scheduled servicing, and pickup included. The quote is confirmed before you hang up, and you receive a written confirmation you can forward to your team.

A quote is firm for the rental as described: the units, the count, the dates, and the address you gave us. If any of those change — more units, longer dates, a different site — the quote gets updated to match, and we confirm the new terms with you before proceeding. We do not change pricing mid-rental on the original scope. What we quoted for what you described is what stands.

Your booking is confirmed when we say it is confirmed on the call and you receive the written confirmation. Until then, dates and inventory are not held. During peak season — spring through fall, when events and construction overlap — inventory moves fast, so the gap between getting a quote and confirming the booking matters. If you need time to decide, tell us and we will tell you honestly how long we can hold the plan.

The person booking the rental must be authorized to do so and must be at least eighteen years old. If you are booking on behalf of a company, an event, or a property owner, you represent that you have the authority to enter into the rental agreement and to grant us access to the site.

Scheduling and Delivery Windows

We schedule delivery in windows, not exact times, because trucks deal with traffic, prior stops, and the occasional flat tire. Your confirmation states the delivery window — typically a half-day block. We hit our windows the overwhelming majority of the time, and if we are running late, you hear from us before the window closes, not after.

Same-day and next-day delivery is often available when you call early in the day during open hours. It is not guaranteed — it depends on truck routing and inventory for your area that day. When you call, we give you a straight answer about what is possible for your address rather than a vague promise. If we say we can make it, we make it.

Someone should be reachable at the site phone number during the delivery window. It does not have to be you — a foreman, a site contact, an event coordinator all work — but the driver needs a live person in case of access questions. If nobody is reachable and access fails, the delivery gets rescheduled, and rescheduling may affect your rental dates.

Weather and road conditions can force delivery changes. We watch forecasts on active routes and will contact you if we need to shift a window for safety — impassable roads, severe storms, or conditions that would put the truck or the crew at risk. We do not charge you for weather-driven rescheduling that we initiate. We do ask for your flexibility when the sky does not cooperate.

Placement Requirements

Units need firm, reasonably level ground that our service truck can reach. That is the core requirement, and it covers most situations. Beyond that, here is what we need from you on placement:

We place units where you ask us to, provided the spot is safe and serviceable. If your requested spot will not work — too soft, no truck access, blocking emergency egress — the driver will propose the nearest workable alternative on the spot. Final placement decisions on delivery day rest with our crew, because they are responsible for getting the truck back out.

Do not move units after delivery without calling us first. Units are placed and leveled for stability and for service-truck access. Dragging a unit to a new spot can damage it, destabilize it, or put it somewhere the service truck cannot reach — which means missed servicing. If a unit needs to move, call (855) 343-0136 and we will reposition it properly.

Servicing Access

Scheduled servicing only works if the service truck can reach the units. Keep the access path clear for every scheduled visit: gates unlocked or codes current, vehicles moved, equipment staged out of the way. On active jobsites, coordinate with your foreman so the service window is not blocked by deliveries or concrete pours.

If the service truck cannot reach your units on a scheduled visit through no fault of ours — locked gate with no code, blocked access, site closed — we will make a reasonable effort to contact you and complete the visit. Repeated access failures may result in the visit being rescheduled, and units that miss servicing because we could not reach them are not our responsibility. Keep the path clear and this never comes up.

Do not lock units shut in a way that prevents servicing. Standard units have occupancy indicators, not padlocks. If your site requires units to be secured overnight, talk to us on the booking call and we will work out an arrangement that keeps both security and servicing functional.

Rental Period

Your rental period runs from the delivery date through the pickup date on your confirmation. The rental is billed for that period as quoted. If you need the rental longer — and construction timelines slip all the time — call before the scheduled pickup and we will extend it. Extensions are routine. What is not routine is holding units past pickup without telling us, because those units are promised to the next customer.

If your project wraps early, call us and we will pull units back and schedule early pickup. Tell us as early as you can so we can rework the route — same-day early pickup is sometimes possible but not guaranteed. Either way, one call handles it.

Abandoned or inaccessible units at the end of a rental — site locked, no contact, no response — remain your responsibility until we can retrieve them. If we cannot reach you or your site contact to arrange pickup, we will keep trying, but the rental period continues until the units are back in our possession. Stay reachable at the end of the rental and this is a non-issue.

Pickup

Standard pickup runs the next business day after your rental period ends. We perform a final pump-out on site, load the units, and leave the area as we found it. If your teardown or demobilization schedule needs us earlier or later, tell us when you book or call before the rental ends — we work around real schedules all the time.

For pickup, the same access rules apply as delivery: the truck needs to reach the units, gates need to be open, and the path needs to be clear. If pickup fails because of access we were not told about, we reschedule and the rental period extends until retrieval. A two-minute heads-up about a locked gate saves everybody a wasted trip.

Leave the units as they are at pickup time. Do not attempt to clean, pump, or dismantle them yourself — servicing equipment requires training and the waste handling is regulated. Just make sure the area around the units is clear and let our crew handle the rest.

Cancellation

Plans change and we get that. To cancel a rental, call (855) 343-0136. The earlier you call, the cleaner the cancellation, because the truck has not rolled and the units are not staged. Cancellations made well before the delivery date are straightforward and carry no penalty beyond any non-refundable booking commitment stated in your confirmation.

Cancellations close to the delivery date are harder on operations — the truck is routed, the units are prepped, the crew is scheduled. Your confirmation states the cancellation terms for your specific rental, including any time thresholds. Read the confirmation when you receive it so there are no surprises. When in doubt, call us early: we would rather rework the schedule with notice than eat a routed truck.

We may cancel a rental if the site is unsafe for our crew, if access representations turn out to be materially false, or if the rental is being used in violation of these terms. If we initiate the cancellation for reasons other than your breach, we refund amounts paid for the unperformed portion of the rental. If the cancellation is due to your breach, the terms in your confirmation apply.

Acceptable Use

Portable toilets are for human sanitation. That sentence should be unnecessary, but experience says otherwise. Do not put anything in the units except what toilets are for and toilet paper. No chemicals, no paint, no solvents, no motor oil, no construction debris, no food waste, no diapers and wipes in bulk, no feminine products flushed in units not rated for them. Foreign material damages tanks, clogs pump equipment, and creates disposal problems at licensed facilities.

Do not use units as storage sheds, do not remove parts or dispensers, do not graffiti them, and do not set fires in or near them. Vandalism and misuse are billed as damage. If your site has a vandalism problem — some urban sites do — tell us on the booking call and we will discuss placement and security options that reduce the exposure.

You are responsible for the units while they are on your site. That means reasonable care: keeping the area around them clear, reporting damage promptly, and not permitting uses that violate these terms. Normal wear from intended use is on us. Damage from misuse, vandalism, or neglect is on you, assessed at our standard damage rates as stated in your confirmation.

Liability Limits

We stand behind our work: clean units, on-time delivery, servicing on schedule. If we fail on any of that through our own fault, we make it right — re-service, redeliver, swap the unit, or credit the affected portion of the rental. That is our commitment, and it is how we have kept customers coming back.

What we cannot do is accept liability beyond the rental itself. We are not liable for indirect or consequential losses arising from your rental — lost event revenue, project delay costs, or other downstream impacts — even if a service failure on our part contributed. Our total liability for any rental is limited to the amounts paid for that rental. This is standard for equipment rental and it is why we would rather over-communicate than over-promise.

You assume responsibility for conditions at your site: ground stability, underground utilities, overhead hazards, and compliance with local permits and placement rules. If a unit sinks because the ground was softer than represented, or a placement violates a local ordinance you did not check, that is on the site operator. Tell us the truth about your site on the booking call and most of these problems never happen.

Waste handling and disposal comply with applicable local, state, and federal regulations. Our techs are trained, our disposal goes to licensed facilities, and our equipment is maintained to standard. If a regulator ever has questions about a unit on your site, call us immediately and we will provide our compliance documentation.

Changes to These Terms

We may update these terms from time to time. The version in effect for your rental is the one posted on this page at the time you book, as referenced in your confirmation. Material changes apply to future bookings, not to rentals already confirmed. If you have an active rental and we change something that affects it, we will tell you directly.
